I don't know--but the folks at Reason.com are on the job. At issue here is the Supreme Court's 20th Century predilection to expansively interpret the commerce clause. But Jacob Sullom asks a good question here--would NOT engaging in commerce be covered by the commerce clause (i.e, choosing not to buy insurance).
I have a feeling that mando insurance would pass constitutional muster.
